Corporate income tax

For corporations whose business income is solely within state boundaries, the tax is four (4) percent of net income. In addition, net income in excess of $50,000 is subject to a three (3) percent surtax. For those corporations with business income both inside and outside the state, the net income attributed to the Kansas operation is based upon the percentage of the corporation’s business located in Kansas. A business’ tax obligation is determined by a three-factor formula using the proportion of sales, property and payroll in Kansas compared to total sales, property and payroll.

State law allows net operating losses to be carried forward to each of the 10 years following the taxable year of the net operating loss.

Kansas Deregulation

In an effort to lower utility prices, many states across the country now offer their citizens “retail choice,” or the opportunity to select an energy supply company. Although the retail electricity market remains regulated, Kansas has enacted incentives to encourage the construction of “merchant power plants” — facilities that generate electricity for sale to retail providers.

Other options, such as the development of renewable energy, are supported by Kansas leaders interested in maintaining a healthy and competitive energy market.

Kansas does not have a Statewide Building Code, as building codes are determined by local jurisdictions, however Kansas does require permitting and environmental regulation. For questions on these issues please contact the resource listed below.

Shawnee County Permitting

Shawnee County does not have an adopted building code but does administer a building permit process to assure that all construction is compliant with the requirements of the Shawnee County Zoning Regulations and other adopted county rules and regulations. Through the building permit process, it is the intent of the County to assure orderly, planned, efficient and economical development of the county; that property can be used safely; that adequate public facilities and improvements exist; and, that improvements comply with all applicable rules and regulations of the county.

Planning & Zoning

Topeka is located within Shawnee County. Depending on the site or building, the planning and zoning may be enforced by either the city or the county. Either way, our community stands ready to assist in development to strengthen our economy and help businesses grow and thrive.

Shawnee County Planning Department

The Planning Department, under the authority and policy direction of the Board of Commissioners of Shawnee County, is responsible for developing, implementing and enforcing County land use policies and regulations; processing and issuing building, zoning, and other development permits; administering county floodplain regulations; and carrying out long-range community planning. The department provides staff support to the Shawnee County Planning Commission, Shawnee County Board of Zoning Appeals, and County Commission.

City of Topeka Planning Department

Current Planning assists property owners, developers, business owners, and neighborhood groups by facilitating the land development and zoning process. Staff handles the review of rezoning and subdivision plat applications; commercial building site and landscape plans; residential building permits; Board of Zoning Appeals variances and appeals; and vacations of streets, alleys, and easements. Staff reviews these applications for consistency and conformance to the City of Topeka’s Zoning Regulations and Comprehensive Plan. A planner of the day is available to answer questions and inquiries on land development, zoning and subdivisions during business hours. Current Planning also arranges pre-application submittal meetings with all of the appropriate City of Topeka staff on matters of land development, zoning, and subdivision platting.
